Generic drugs are not patented; however, a patent does not make a product more or less reliable, a patent is just in place for branding 'rights'.
The reason why you patent a product is so you have the official rights to manufacture and distribute it for a set period of time. However, these rights are in effect until the patent expires.

1) Patent has expired.
2) The patent is invalid.
3) There was no patent in place from the start.
4) The government did not pass the patent.
